Why Virginia Paystubs Must Itemize Hours and Rate

Since 1 January 2020 a Virginia employer cannot settle for handing over a net figure. Code 40.1-29 makes the written statement a per pay date obligation and for anyone paid by the hour it has to carry the hours worked and the rate of pay as visible, addable numbers. This generator is built around that one sentence of statute: hours and rate are separate inputs and they land on the finished document as separate printed lines rather than being folded into a single gross amount.

That distinction matters more here than in most states. A Fairfax County subcontractor billing labor hours against a federal task order and a Virginia Beach restaurant running split shifts both produce records someone may read back line by line later and the statute asks whether the employee could work out how gross and net pay were reached from the document alone.

What Has to Survive Onto the Finished Document

The written statement subsection of Code 40.1-29 lists five things: the employer name and address, the number of hours worked in the pay period, the rate of pay, the gross wages earned in that period and the amount and purpose of every deduction. It closes with a catch-all that does the real work, requiring sufficient information for the employee to determine how gross and net pay were calculated.

Which Workers Need an Hours Line on Their Pay Stub

The hours element is not universal. It attaches to employees paid on an hourly basis and to salaried employees who are not exempt from overtime under section 13(a)(1) of the Fair Labor Standards Act. Every element the statute names is present and checkable: hours, rate, gross, each deduction with its purpose. A reader can multiply 80 by 24.50, confirm the overtime rate is 1.5 times $24.50 and total the deduction column. The first $17,000 produces a fixed $720. The remaining $30,490.88 is taxed at 5.75 percent, giving $1,753.23. Annual tax is $2,473.23.
