Article 10 and the Missing State Tax Line

Section 1 of Article 10 of the Nevada Constitution says no income tax shall be levied on the wages or personal income of natural persons. There is no Nevada withholding table, no state version of the W-4 and no city wage tax. Only the federal Form W-4 affects the tax withheld from a Nevada paycheck.

The deductions an employee in Henderson or Elko normally sees are therefore federal income tax, Social Security at 6.2% on wages up to $184,500 and Medicare at 1.45% with no cap. Medicare rises by another 0.9% on wages above $200,000 in a calendar year.

Why the Modified Business Tax Never Reaches the Employee

Nevada does tax payroll, but the bill goes to the business. Every employer subject to the state unemployment law also owes the Modified Business Tax on gross wages minus employer-paid health benefits. For most general businesses the rate is 1.17% and the first $50,000 of wages each quarter is not taxed. The Department of Taxation's Modified Business Tax page covers the rates; its FAQ answers the question of deducting the tax from employee wages with a plain no.

Unemployment insurance works the same way. The employment security division's notice to employees states that no part of the contribution is deducted from employee wages. Neither tax should ever show up as a deduction on a Nevada pay stub.

A Flat $12.00 Wage With Tips Kept Separate

Article 15, Section 16 of the constitution sets the $12.00 rate. Because tips cannot offset any part of it, a server's stub shows the full hourly wage and lists tips as additional income rather than as part of the minimum.

The $18.00 Threshold Behind Daily Overtime

NRS 608.018 adds a daily overtime rule that federal law does not have. The Labor Commissioner's 2026 bulletin puts the line at $18.00, one and a half times the minimum wage:

  • Paid under $18.00 an hour: time and a half for more than 8 hours in a 24-hour period or more than 40 hours in a workweek.
  • Paid $18.00 or more: time and a half only after 40 hours in a workweek.
  • Four tens: a mutually agreed schedule of four 10-hour days in a week does not trigger daily overtime.
  • Exclusions: certain groups such as outside buyers and some commissioned retail staff fall outside the rule.

A warehouse worker earning $17.50 who works a 10-hour shift outside an agreed four-ten schedule should see 2 overtime hours on that check.

Desert Line Logistics Example: No State Line to Compute

Scenario: hourly employee of Desert Line Logistics LLC, 3500 W Sahara Ave, Las Vegas, NV 89102. Paid biweekly at $21.00 an hour for 80 hours, single on the federal W-4. Pay period Sep 14 to Sep 27, 2026, pay date Sep 29, 2026. This is the 20th check of the year.

There is no state line to calculate. Medicare at 1.45% of $1,680 comes to $24.36 and Social Security at 6.2% comes to $104.16. Federal income tax follows the IRS tables for a single filer. Subtract all three from gross pay and $1,433.73 remains. Year-to-date wages of $33,600 are far below the $184,500 Social Security limit, so the full 6.2% still applies.

What NRS 608.110 and 608.0197 Put on the Statement

NRS 608.110 requires the employer, at the time wages are paid, to furnish an itemized list of the deductions taken from total wages. A lump net figure on a deposit notice is not enough.

Private employers with 50 or more employees in Nevada also owe paid leave under NRS 608.0197. Employees earn at least 0.01923 hours for each hour worked, may use it from their 90th day for any reason and may be capped at 40 hours of use and 40 hours of carryover a year. New businesses are exempt for their first two years, as are temporary, seasonal and on-call employees.

Covered employers must give each employee an accounting of available leave hours on every payday. The statute lets them use their payroll system for that. Semimonthly Pay and Wages Due the Day of Discharge

  • Pay schedule: private-sector wages are due at least semimonthly (NRS 608.060) and regular paydays must be posted in two conspicuous places (NRS 608.080).
  • Discharged or laid off: all earned wages are due immediately (NRS 608.020).
  • Resigning: wages are due by the next regular payday or within seven days, whichever is earlier (NRS 608.030).
  • Late final pay: wages keep running at the same daily rate until paid, for up to 30 days (NRS 608.040).
